Canadian Work Permit Requirements: Are You Eligible?
If you are looking into applying for a work permit in Canada, you should find out if you fulfill the Canadian work permit requirements, and if you need to meet other requirements. The type of work in which you are interested will determine if you need a permit, the processing times, and if there are any prerequisites.
In addition to a work permit, you would be required to obtain a temporary resident visa when you visit Canada. Thus, you would need to meet to general requirements for entering and staying in the country.
In most cases, you’re only able go apply for a work permit when you are outside of Canada, but there are circumstances when you can apply from within Canada or while you are entering.
In order to meet the Canadian work permit requirements, you would only be eligible if:
- you currently have a valid study or work permit, or your spouse or parents have a study or work permit
- you have a work permit for one job but you are interested in obtaining a work permit for a different job
- you have a temporary resident permit that is valid for six months or more
- you have already applied for permanent residence. Before you can apply for a work permit, you will have to pass certain stages of the main application process.
Whether you are outside Canada or within, the same documents are necessary to submit:
- a job offer from a Canadian employer
- a completed application that indicates that you meet the requirements of the Immigration and Refugee Protection Act and the Immigration and Refugee Protection Regulations
- written confirmation from Human Resources and Skills Development Canada (HRSDC) that indicates the employer can offer a position to a worker from another country. This is known as a positive labour market opinion. Generally, your employer is responsible for getting the confirmation. Depending on the job, a labour market opinion might not be necessary.
Furthermore, when applying from within or outside Canada, the following tasks must occur:
- assure a visa officer (if outside Canada) or an immigration officer (if within Canada) that once the work permit expires, you will leave the country
- prove that you can support yourself and your family financially while staying in Canada
- possess no criminal record and continue to commit no offenses. A police clearance certificate may be necessary. This is a criminal and security check to determine whether you have a record.
- show that you are not a security risk
- be in good health. A medical examination may be necessary.
When applying as you enter Canada, you must meet these Canadian work permit requirements:
- you are exempt from needing a temporary resident visa
- you do not need a labour market opinion from HRSDC for your job (some exceptions apply)
- you have a labour market opinion from HRSDC
It would still be possible to apply for a work permit as you enter Canada if your job needs a labour market opinion, provided that the positive opinion was issued before you enter (except for live-in caregivers and seasonal agricultural workers).
